ANAHEIM, CA - (March 15, 2005) - The City of Anaheim today was informed that the California State Court of Appeal has ordered the Anaheim Angels to show cause why the Orange County Superior Court should not be ordered to set aside its denial of Anaheim's motion for a preliminary injunction in Anaheim's case against Angels Baseball, L.P. A superior court judge had denied the City a preliminary injunction to prevent the Anaheim Angels from using the name "Los Angeles Angels of Anaheim" pending a trial. The hearing date has been set for March 28, 2005 at 1 p.m., just four days prior to the start of the annual Freeway Series between the Anaheim Angels and the Los Angeles Dodgers. "We have always been confident of the merits of the City's arguments and we are pleased that the Court of Appeal has acted immediately to review our case," said Anaheim Mayor Curt Pringle. "This court date gives the City another opportunity to re-claim its baseball team before the opening day of the 2005 season. Each day that passes with the team named after another city in another county erodes Anaheim's reputation as a Major League city and causes irreparable harm to Anaheim and Orange County. As fans everywhere have seen, 'Anaheim' is consistently disappearing from the team name when it is used by the media, by other baseball teams, and even by the team itself."
Andrew J. Guilford, who serves as co-counsel for the City in the case along with Mike Rubin, filed the writ at the Court of Appeal.
"Angel fans have a palpable pride, and perceive a prejudice against their community in the name change," wrote Guilford in replying to the Angels' response to the writ of appeal. "This case has attracted a lot of attention because people care deeply about this issue. But, ultimately, this case is about contract law, and about the power and responsibility of courts to protect the unique rights of parties."
