ABC Determinations
The State of California Department of Alcoholic Beverage Control (ABC) is charged with the responsibility under state statute to review and issue licenses for the sale and/or manufacture of alcoholic beverages. The City has been designated to make determinations of public convenience or necessity for all applications except for non-retail, hotel, motel, restaurant, and manufacturing establishments if the proposed license is located in an area of high crime or overconcentration of licenses. Public Convenience or Necessity (PCN) is a discretionary action decided by the Planning Commission or City Council only after reviewing the location, need and surrounding land uses.

Administrative Adjustments
An Administrative Adjustment is an
administrative decision by the Zoning Administrator which provides for minor
deviations from certain dimensional or percentage site development
requirements of the Zoning Code.

Amendment to Conditions of Approval
Annexations
Annexation of land into the City of Anaheim requires public hearings by the Planning Commission and City Council followed by Local Agency Formation Commission (LAFCO) hearings. The benefits of annexing property include an improvement in the delivery of government services, land use compatibility, local code enforcement services and a clearer understanding of jurisdiction by the community. The Pre-File Application and the Reclassification Application contain filing submittal requirements. Applicants should also contact LAFCO (a state mandated local agency) at (714) 834-2556 for additional information and applications.
Business Licenses (Zoning Clearance)
The Planning Division verifies
consistency of business operations with a property’s designated zoning as a
part of the Business License approval process. An application for a Business
License may be obtained at the Business License public counter at 200 South Anaheim Blvd., 1st floor.
Christmas Tree Lots and Pumpkin Patches
A Special Event Permit (issued by the
Planning and Zoning Division of the Planning Department) and a City of
Anaheim Business License and a Christmas Tree Lot/Pumpkin Patch Permit
(issued by the Business License Division of the Planning Department) are
required. Contact the Business License Division for further information.
Conditional Use Permits (CUP)
The Zoning Code lists certain land uses that require a Conditional Use Permit (CUP) so that the Zoning Administrator, Planning Commission, or City Council can impose conditions of approval to ensure the peace, health, safety and general welfare of the adjoining area. The Pre-File Application and Conditional Use Permit and Variance Application Form contain detailed submittal requirements. The Request for Reinstatement Submittal Requirements
contains filing instructions to apply for reinstatement of an existing
Conditional Use Permit that has a condition of approval with an expiration
date.

Environmental Reviews
Certain land use proposals are subject to the requirements of the California Environmental Quality Act (CEQA). Applicants submitting requests for public hearings or meetings must complete an
Environmental Information Form to initiate an environmental analysis (Initial Study) of the project to ensure compliance with CEQA.
Please use the Environmental Checklist to identify environmental factors that may be potentially affected by the project.
Final Plan Approvals
Conditions of approval of a public hearing item, e.g., a conditional use permit, can require review and approval of final plans, such as floor, elevation, landscape or sign plans. Final Site Plan Reviews
The development standards of certain zones require the review and approval of a Final Site Plan. A Final Site Plan is a complete and precise set of development drawings including a site plan, floor plans, elevation plans, landscape and irrigation plans, sign plans, lighting plans and such other plans and/or information which may be required to fully illustrate the proposed project. General Plan Amendments
The City of Anaheim general Plan provides the primary policy document that provides direction and guidance for all land use and ongoing considerations within the City. Careful consideration is given to any request to amend this important policy document. Therefore, the property owner requesting a General Plan Amendment (GPA) needs to weigh the appropriateness of such an amendment and whether the change would be in the best interest of the City and surrounding properties. The applicant must file a Pre-File Application and a Petition for General Plan Amendment.

Home Occupation Registrations
A Home Occupation Registration is required for all home-based businesses.
This registration is required in conjunction with a Business License.
Business License and the Home Occupation Registrations may be requested at
the Business License Public Counter at City Hall East, 200 South Anaheim
Boulevard, 1st floor, 714-765-5139 or on-line.
Large Family Daycare Permits (nine or more children, including children under the age of 10 who live at home)
A City business license and a
State of California Day Care License are required. To apply for this permit,
visit the Planning and Zoning Public Counter at 200 South Anaheim Blvd., 1st
floor.

Pre-File Review
The Pre-File process is a review of a project by City staff prior to the submittal of a petition for Planning Commission consideration of a Zoning Action (E.G. reclassification, Variance, Conditional Use Permit). The Pre-File process allows for a thorough analysis of a proposal and helps clarify City requirements of the project for the applicant. Pre-File also allows the City staff to become familiar with the project and determine what steps are necessary to help process it through the system to make recommendations for further processing. Reclassifications
A reclassification, commonly known as rezoning, may be requested in order to develop a piece of land for a particular use, to bring the zoning into compliance with the General Plan, to be consistent with adjacent zoning or a combination of these reasons. Self-Help Planning and Zoning Records (Public records such as public hearing and meeting records)
The Planning and Zoning Division
located at 200 South Anaheim Blvd., 1st floor, is open from 8 a.m. to 5
p.m., Monday through Friday for research and review of public records. Staff
is always available to answer questions related to planning and zoning. The

Special Circumstances Waivers
The Zoning Administrator, without a public hearing and subject to zoning
code provisions, may approve a Special Circumstances Waiver from the Special
Event Permit regulations.

Special Event Permits
A Special Event Permit (SEP) is an authorization to conduct a short-term special event on private property, regardless of whether the event is associated with a business or non-profit. A special event could include the posting of flags, banners, balloons, and outdoor sales in zones that allow special events. This permit is needed to ensure that the particular event is appropriate when considering the use of the property and surrounding properties, and that the event is conducted in a safe and orderly manner. Specimen Tree Removal Permits
Discretionary
The Zoning Code protects specimen trees (in the Scenic Corridor Overlay Zone) defined as Eucalyptus (5 or more on a parcel [a “stand” regardless of size], and Oak, Pepper and Sycamore trees with trunks measuring eight (8) inches or greater in diameter, measured at a point four (4) feet above ground level. Approval of a Specimen Tree Approval Permit by the Planning Commission is required to remove healthy specimen trees that are not an endangerment to their surroundings.

Non-discretionary
The Zoning Code protects specimen trees (in the Scenic Corridor Overlay Zone) defined as Eucalyptus (5 or more on a parcel [a “stand” regardless of size], and Oak, Pepper and Sycamore trees with trunks measuring eight (8) inches or greater in diameter, measured at a point four (4) feet above ground level. Administrative approval can be granted for the removal of diseased specimen trees (as determined by a licensed tree surgeon) or trees that could be a source of danger to the immediate vicinity due to their condition. The applicant must complete the Specimen Tree Approval Permit application and provide supporting documentation for permission to remove diseased, dead or dangerous trees and submit it to the Planning and Zoning Public Counter (200 South Anaheim Blvd., 1st floor) prior to the removal of the trees. There is no fee for this permit.

Telecommunication Antennas
Discretionary
Telecommunication facilities with visible antennas (whether freestanding or
mounted to a structure) require the approval of a Conditional Use Permit.

Non-discretionary
Administrative approval can be granted for “stealth” telecommunication
facilities, including antennas and equipment that are completely hidden from
view. Applications are subject to a Telecommunication Antenna Review Process.

Tentative Parcel and Tentative Tract Maps
The subdivision of land requires City approval. The Zoning
Administrator may approve Tentative Parcel Maps only, with up to two
waivers. All other applications must be approved by the Planning Commission.

Variances
A variance, sometimes called a code waiver, is needed when there are special circumstances applicable to a property, including size, shape, topography, location or surroundings, which do not apply to other property under identical zoning classification in the vicinity or when special circumstances show that strict application of the Zoning Code would deprive the property of privileges enjoyed by other property under identical zoning classification in the vicinity. Zoning Compliance Letters
The Zoning Division of the Planning Department responds to requests for written verification of zoning and entitlements on a property To request a Zoning Compliance Letter, submit a written request containing the property address(es), assessor’s parcel number(s) if known, and the applicable fee to the Zoning Division of the Planning Department at 200 South Anaheim Blvd., Anaheim, CA 92805.
