Affidavit Extension

If an STR owner wishes to file an “affidavit extension”, the “affidavit extension” application must be filed by Friday, June 16, 2017, unless the deadline is extended by written directive of the Planning Director.  The “affidavit extension” is separate from the hardship extension process and may extend the period before which a hardship extension is necessary to August 11, 2019.  The City’s intention is that determinations on the affidavit extensions will be made by July 17, 2017 so STR owners will have time after the determination to make decisions on whether or not to file a capped or regular hardship extension application.

Capped and Regular Hardship Extension

If an STR owner wishes to file for a “capped extension” or regular hardship extension, the hardship extension application form must be submitted by Monday, August 14, 2017.  The application has been changed to allow an owner to request the “capped-extension” option by checking the box at the top of the hardship extension application form.  If the “capped extension” is requested and approved, a short-term rental owner will have until August 11, 2021 to terminate short-term rental use of the property.  If the “capped extension” is denied, there is no appeal from the denial, but the application will then be processed pursuant to the regular hardship extension application procedures.

Submittal Deadlines

An “affidavit extension” or “capped or regular hardship extension” application may be submitted to the City during the City’s regular business hours which are Monday through Friday 8:00 AM to 5:00 PM.  Applications must be submitted to the Planning and Building Department, first floor of City Hall, located at 200 S. Anaheim Boulevard.  All applications must be submitted by the specified deadlines no later than 5:00 PM.  Applications submitted after specified deadlines will not be accepted unless the Planning Director has issued a written directive extending that deadline.
